отходыBringing national legislation in the field of hazardous waste management in line with the European requirement is enshrined not only in the international conventions ratified by Ukraine, but also in the Association Agreement. However, Ukraine is in no hurry to meet the European standards. Thus, the target state program has not been developed due to the alleged lack of funds the state budget and bills are necessary only in the development stage.

The Ministry of Ecology and Natural Resources developed a draft version of the Law of Ukraine “On Waste”. However, today this bill has a number of comments from other central authorities reported.

“With regard to the development of the state target program of treatment of waste is to note that the concept of national treatment programs with waste for 2013-2020 approved by the Cabinet of Ministers of Ukraine dated 1/3/2013 number 22-p. Accordingly, a draft program of national treatment of waste for 2013 -2020 years.

At the same time the Cabinet of Ministers of Ukraine of 01.03.2014 №65 “About saving public money and avoiding budget” approved activities for the economic and rational use of state funds provided for the maintenance of public authorities and other public bodies formed by state authorities enterprises institutions and organizations that use state budget funds. Clause 16 of these events provided the termination of drafting state programs or changes to the approved target programs that require additional funding from the state budget, in addition to programs approved by the Cabinet of Ministers of Ukraine dated October 29, 2003 № 1684 (restricted).

Currently, in accordance with the Agreement on Association between Ukraine, on the one hand and the European Union and its Member States, on the other hand the Ministry of Environment developed a new draft of the Law of Ukraine “On Waste”, in accordance with the requirements of Directive 2008/98 / EC on waste (Framework). Draft Law of Ukraine “On Waste” on March 3, 2016 №5 / 1-7 / 2050-16) sent to the relevant central bodies of executive power “, – reported in the Ministry of Environment.

According to the agency, in the Ministry of Environment has received comments from the Government Office for Jewish integration, the State Statistics Service of Ukraine, Ministry of Regional Development, Ministry of Economic Development and Trade of Ukraine.

Recall, Ukraine has not fulfilled the requirements of the Basel Convention regarding the control of Transboundary Movements of Hazardous Wastes and their Disposal. According to the audit of the Accounts Chamber of Ukraine, hazardous wastes are imported, transported and exported from the country virtually unchecked.

For example, shipments of hazardous waste at the border with Ukraine are not sealing, and hence to control the further fate of hazardous waste on the territory of Ukraine is impossible.

As previously reported, the Cabinet approved the license terms for companies that are engaged in or planning to engage in the disposal of hazardous waste. Thus, to obtain a license for such an activity, enterprise-applicant sufficiently documented to inform the Ministry of Environment that for that they have all the necessary equipment and facilities. And after 5 days of the Ministry of Environment will issue a license to such enterprise.

In this case, neither the Ministry of Environment, or any other authority will not check the accuracy of these data. The main criterion – that said information is now coincide with the requirements approved by the licensing conditions.

As a result of this formal procedure, experts say, the licenses issued to enterprises “blindly”, and those instead of hazardous waste, store them in the best case in the hangars near the places of social activity (residence, work, etc.), thus creating a threat not only to the environment but also the health of people.

The authorities recognized that there is a problem, but solve it can only in Parliament, because the current the people’s representatives “forgot” to give the licensing authority, ie the Ministry of Environment, the authority to pre-licensing inspection companies and now, any such inspection is illegal, what actually are disposers of hazardous waste.

This is confirmed by the head of BP Subcommittee on public policy issues in the field of waste management, MP Serhiy Trigubenko. In particular, he noted that the lack of control on the market promotes greed of unscrupulous entrepreneurs.

The politician repeatedly filed bills that specifically included the granting authority Ministry of Environment for review businesses that recycle hazardous waste. However, all the bills have been failures of people’s deputies.

MP explained that in particular the existence of a powerful lobby in the market, which is trying at all costs to keep the market in chaos.

“It makes all the lobby today, so as not to spend money on the disposal of hazardous waste, and only pretend that they’re something to dispose of this lobby and I felt myself too.” – He said.
